1) SCOPE
1.1 The following terms and conditions apply to all contracts with:

(hereinafter referred to as “VY”)
1.2 The following are offered:
• Seminars | Workshops (Yoga Alliance Certification)• Teacher training | YA certified training and further education (also online)
• Employee yoga for companies and clubs (also online)• Open yoga classes including meditation (also online)• Therapeutic yoga & meditation in individual settings or small groups (also online)• Systemic coaching (also online)• Craniosacral bodywork• Singing bowl meditations
• Retreats (separate terms and conditions apply for each event. These will be sent after the reservation and before the booking.)
2) ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
2.1 Each participant/client/offer recipient/yoga student/legal guardian (hereinafter referred to as “participant”) accepts these terms and conditions by booking or making an appointment (verbally and/or in writing) and participating/taking advantage of the above-mentioned offers.
3) OBLIGATION TO PARTICIPATE, EXCLUSION
3.1 Participants are called upon to participate in a morally responsible manner. Absences or the decision to cancel an already booked event are the sole responsibility of the participant and do not constitute grounds for a refund of participation fees.
4) PERSONAL RESPONSIBILITY AND SUITABILITY
4.1 Participants acknowledge that they participate in the above-mentioned offer at their own risk.
4.2 VY assumes no liability of any kind, including for any resulting consequences. With regard to suitability for participation, the participants themselves are responsible for ensuring that they are physically fit to take part in the activities.
4.3 Participants must ensure in advance that they are able to take part. Reimbursement is excluded due to an illness known prior to the conclusion of the contract that makes participation impossible.
4.4 The offers are health prevention services and other yoga offers outside the medical field. Healing or other medical services are not part of the offer. For treatment of an existing illness, participants are requested to contact their treating doctor or alternative practitioner. Participants also assure that they do not suffer from a contagious disease.
5) DISCLAIMER
5.1 VY does not make diagnoses! VY is not liable for personal injury, property damage or financial loss. VY is liable for the proper functioning of the aids it provides (mats, belts, blocks, blankets, etc.). However, VY is not liable for any damage to health suffered by participants as a result of taking part in the program, nor for accidents caused by the participants themselves, nor for property and valuables brought along. The use of VY services is at your own risk.
5.2 VY endeavours to ensure that the content and the data and information provided as part of its services are correct and complete. However, no guarantee can be given for the timeliness, correctness, completeness or quality of the information provided. Liability claims against VY relating to material or immaterial damage caused by the use or non-use of the information provided are fundamentally excluded, unless VY can be proven to have acted intentionally or with gross negligence.
6) COPYRIGHT
6.1 Please note that the copyright of all scripts and publications lies with VY and that any further use of them, in particular reproduction or distribution to third parties, is prohibited or requires the express written permission of VY.
6.2 By signing the registration form, participants agree that photos or films taken during the course may be used in audiovisual or print media without remuneration and without time or geographical restrictions, with their consent. Participants do not acquire any rights to the use of intellectual property rights, course names or advertising materials for the respective course.
7) PRICE CHANGE
7.1 VY reserves the right to change the applicable prices.
7.2 Cards and contracts already purchased remain valid at the agreed price at the time of purchase until the end of the contract term.
8) YOGA CLASSES | GROUP TEACHING: INDIVIDUAL AND BLOCK CARDS
8.1 Single and multiple tickets entitle participants to a certain number of teaching units. Cancellation is not possible.
8.2 Cards for 5, 10, 20 or 1 month unlimited units (EH) are valid from the date of issue for the duration and number of EH stated in the price list/offer and for 1 person each. These cards are not transferable. Any unused teaching units expire after the deadline.
8.3 Some yoga classes are limited to a certain number of participants due to space constraints. By registering for a yoga class, participants secure a fixed place.
8.4 Registration without receipt of payment of the participation fee is only considered a non-binding reservation and does not guarantee a fixed place for the participant.
8.5 If you register for a yoga class, you can cancel free of charge up to 3 hours before the start of the class.
8.6 A participation fee already paid will be credited by VY for another lesson (but not refunded in amount).
8.7 Participation in the yoga classes is possible without prior registration and with registration without advance payment of the participation fee, however, VY reserves the right to exclude unregistered participants or registered participants without paid participation fees from participation in the event of overcrowding.
8.8 Tickets for online units (EH) are valid from the first booked/deregistered unit (EH) for the duration of the online offer and according to the price list/offer. Cancellation is required up to a maximum of 30 minutes before the EH - otherwise an appointment that has been booked/registered is considered to have been used (even if you do not attend). These tickets are not transferable. Any unused teaching units expire after the deadline (i.e. after the expiry of the validity).
8.9 ONLINE yoga sessions booked and paid for online cannot be cancelled. Please only register if you are sure you will attend.
8.10 For the online units, the equipment listed in the timetable (described separately for each unit), technical equipment and functionality must be organized and provided by the participant themselves. VY accepts no responsibility for equipment, technical equipment and functionality that is not available or does not work. A booked appointment that cannot be attended due to technical problems on the part of the participant is considered to have been used.
9) THERAPEUTIC YOGA AND OFFICE YOGA - SINGING BOWL MEDITATIONS - CRANIOSACRAL BODYWORK
9.1 Appointments can be made online, by telephone, in person or in writing and are binding.
9.2 Appointments booked (online, verbally and/or in writing) that are cancelled by the participant less than 24 hours before the agreed appointment are non-refundable, i.e. the full fee will be invoiced and, unless already paid in advance, is due from the invoice date.
9.3 In the event of illness or accident, the participation fee (paid or outstanding) can be credited towards another VY offer upon presentation of a medical certificate and simultaneous cancellation by telephone at least 24 hours in advance.
9.4 Craniosacral bodywork, coaching, singing bowl meditation or classical therapeutic yoga session is carried out at the participant’s own risk.If you suspect you have a serious mental or physical illness, please always contact your doctor or psychotherapist first and/or, if you are currently undergoing medical/psychotherapeutic/alternative medicine treatment or have recently undergone one of the practices mentioned, please discuss it with the relevant doctor or therapist beforehand.
9.5 VY can and may only work in an accompanying and supportive manner and therefore strictly rejects the discontinuation of existing conventional medical, psychotherapeutic or alternative medicine therapies as well as the discontinuation of drug treatments due to the aforementioned practices.VY neither criticizes nor rejects conventional medicine or other forms of therapy. VY respects every other belief, even if it is not its own. The practices offered by VY never replace the treatment of a doctor, alternative practitioner or psychotherapist! Furthermore, VY is not legally permitted to make promises of healing or to make diagnoses of a psychological, therapeutic or medical nature. VY is not liable for any direct or indirect material, health, psychological or immaterial damage of any kind that could arise from the use of one of the therapies listed during the session and/or afterwards, as well as for material or health damage that could arise from staying in the VY practice/premises! The same applies to the journey to the practice/an appointment and the journey back.
9.6 Each application is carried out at the participant's own risk and responsibility. With regard to the above information, participants are asked to sign an acknowledgement form before beginning the application in practice.
9.7 Participants are not obliged in any way to attend a specific number of sessions. After the first session, it is of course up to the participant to decide whether or not to attend further sessions.
9.8 Personal data will not be passed on to third parties by VY! If personal data (name, address, email address, etc.) is collected on this website, this is done with the voluntary consent of the user and with their knowledge.
10) SEMINARS | WORKSHOPS | TRAINING/FURTHER EDUCATION
10.1 Registrations for seminars, workshops, training/further education (online and offline) are binding; the place is reserved after receipt of payment of the respective deposit fee (this is non-refundable!) or participation fee for training/further education.
10.2 After registering, interested parties will receive a confirmation email from VY. Upon receipt of the email, the participation fee or deposit fee for training/further education is due. The place is secured when the payment is received in VY's account. The deposit fee is non-refundable.
10.3 Registrations will be considered in the order in which they are received.
10.4 The contractual relationship is legally effective upon confirmation of registration by email.
10.5 If an application cannot be considered, the interested party will be informed immediately.
10.6 Only registrations from adults will be accepted without exception. Minors must be represented by their parents.
10.7 A refund of the deposit fee is not possible. A refund of the remaining payment or participation fee for ALL training/further education courses is only possible if the reserved place is taken over by another participant.
10.8 In the event of illness or accident, the participation fee paid can be credited towards another offer (of the same type) by VY upon presentation of a medical certificate and simultaneous cancellation by telephone at least 24 hours in advance.
10.9 Technical requirements for ONLINE events (e.g. training/further education, workshops, etc.): To participate in online events, participants must ensure that they have a device with speakers and camera (PC/laptop, tablet or smartphone), a stable internet connection and an up-to-date browser. The equipment, technical features and functionality must be organized and provided by the participants themselves. VY accepts no responsibility for equipment, technical features and functionality that is not available or does not work. A booked appointment that cannot be attended due to technical problems on the part of the participant is non-refundable and is considered to have been used.
10.10 The respective access link to the ONLINE events (e.g. training/further education, workshops, etc.) will be sent by email to the email address provided in the booking form a few days before the start of the respective event. However, only after receipt of the remaining outstanding amount.
11) RESERVATION/WAITING LIST
11.1 If an event is fully booked, you have the option of being placed on a reservation/waiting list.
11.2 Should a place become available, the interested party will be notified immediately by VY.
12) APPOINTMENT CANCELLATIONS
12.0 According to the General Terms and Conditions, point 10.4, the contractual relationship is legally concluded with the registration confirmation by email (from ViennaYoga to the registered participant), deregistration (in the event of non-participation) is absolutely necessary from this point onwards.
12.1 Cancellations will only be accepted in written form (email) and confirmed in writing.
12.2 If you cancel your registration up to 30 working days before the start of the seminar, workshop, training or further education course, no cancellation fee will be charged. However, the deposit amount is non-refundable!
12.3 In the event of cancellation between 29 and 15 working days before the start of the event, a processing fee of 30% of the gross invoice amount will be charged and between 14 and 7 working days before the start of the event, a processing fee of 50% of the gross invoice amount will be charged in addition to the non-refundable deposit amount.
12.4 In the event of later cancellations (from 7 working days before the start of the event), the entire participation fee will be charged. This also applies if the participant does not attend the course without timely cancellation.
12.5 A replacement participant can be provided at any time; this will replace the cancellation fee.
12.6 Should it become necessary to demand payment of the course fee by means of a reminder, additional reminder and processing costs (€ 9 per booked place) and a registration fee (€ 3.70) will be charged. Cancellation fees (including unpaid participation fees/invoices) will also be demanded by means of a reminder procedure.
12.7 Special regulations for yoga classes and online yoga classes: Free cancellation is possible up to 60 minutes before the start of the class.
12.8 When booking/registering for ONLINE yoga sessions with the ONLINE yoga block card, a cancellation period of up to 30 minutes before the session begins applies - otherwise an appointment that has been booked/registered once is considered to have been taken (even if you do not attend).
12.9 ONLINE yoga sessions booked and paid for online (INDIVIDUALLY, i.e. WITHOUT a yoga block card) cannot be cancelled. Please only register if you are sure you will attend.
12.10 For ONLINE events (e.g. training/further education, workshops, etc.), a booked appointment that cannot be attended due to technical problems on the part of the participant is considered non-refundable and is therefore considered as consumed. For additional information, see T&Cs point 10.9.
13) PAYMENT METHODS AND BANK DETAILS
13.1 The prices of the respective offers can be found on VY’s website and in its current advertisements.
13.2 For offers with compulsory registration, the participation fee must be transferred before the start of the event. The participation fee is due upon registration and must then be transferred without delay to the bank details provided.
13.3 Payment default occurs if the claim is not settled within a set period of time. Any processing fees and court reminder fees are to be borne in full by the participant. In the event of payment default, VY is entitled to withdraw from the contract and pass the course place on to other people.

14) RIGHT OF WITHDRAWAL
14.1 There is no right of cancellation, even though this is a distance contract, because it is a contract for leisure activities that take place on specific dates or periods (Section 312g No. 9 in conjunction with Section 355 of the German Civil Code).
15) SEVERABILITY CLAUSE
15.1 If individual components of the terms and conditions are invalid, this shall not affect the validity of the remaining components.
15.2 In this case, the parties shall accept the valid provision that comes closest in content to the regulatory intention of the invalid component (www.viennayoga.at).
16) HOLIDAYS, REPLACEMENTS, ILLNESS, NUMBER OF PARTICIPANTS, COURSE ENROLLMENTS, CHANGES OR CANCELLATION OF THE OFFER
16.1 The offer, the timing and location of the individual courses and offers can be changed by VY in a way that is acceptable to the contracting party, can deviate from this or can be omitted entirely. The same applies to the temporary discontinuation of an offer.
16.2 VY points out that the content and process of offers can be changed, provided that the overall character of the same is fundamentally preserved. This does not entitle the participant to withdraw from the contract. Any claim for damages is excluded.
16.3 VY is free to set and limit the maximum number of participants (course occupancy) depending on the course, generally or in individual cases, if this is necessary for compelling organizational reasons, particularly spatial reasons, in the interest of the participants. A limit will be announced in the course of the respective offer or determined in individual cases by the course leader.
16.4 The implementation of individual offers is tied to the achievement of a minimum number of participants by a certain deadline. If the number of registrations is lower, the offer can be changed, postponed or cancelled.
16.5 If an event cannot be held due to insufficient numbers of participants, illness, accident, the absence of a speaker or due to force majeure (e.g. environmental conditions) on the part of VY, the registered participants will be informed immediately and will receive a full refund of the participation fee. At the request of the participant, a credit for an event at a different date will be issued instead of a refund. VY cannot accept any further liability due to loss of earnings, etc. Further claims, in particular costs for rooms already booked, travel costs, etc. cannot be asserted. VY is free to cancel an event or to reschedule it at a new date to be agreed, excluding any liability for damages.
16.6 In the event of illness, vacation or other inability to attend, VY will endeavor to organize a replacement for the respective offers. If this is not possible, an offer may be cancelled. In this case, the refund and exclusion of liability mentioned in the previous paragraph apply.
17) JURISDICTION AND CHOICE OF LAW
17.1 The place of performance and jurisdiction for all services and disputes is exclusively the registered office of the service provider - the place of jurisdiction for VY is Vienna.
17.2 The application of the UN Convention on Contracts for the International Sale of Goods is excluded and not legally binding.
17.3 Austrian law applies exclusively.
17.4 The jurisdiction agreement applies equally to domestic and foreign customers.
